Abstract
Article 118 of the 1949 Geneva Convention (concerning the treatment of prisoners of war), which requires the active involvement of POWs released without delay and will be returned to their homeland. The captor’s commitment to restore prisoners to their home country and has captured a clear right to be returned to their homeland. We will see that for captives who wish to return to their homeland is no right not to be returned to his home country is not predicted.
